FAQ - If a driver is involved in an accident and is issued a citation but..?

If a driver is involved in an accident and is issued a citation but is not hurt and vehicle is not towed, does the driver have to be tested? And would it be considered DOT reportable because of the citation?

 

Answer

If the accident does not meet the definition of a FMCSA accident (fatality, any party injured, or any vehicle towed), then the drug testing requirements do not apply, even if the driver is cited. No, citation alone does not make an accident recordable. The citation only has to do with if the driver must be drug tested following injury or towed accidents.
