How can a driver rebut information in his/her record?

Answer:

Drivers who want to rebut information in their records have to send the rebuttal to the previous employer with instructions to include the rebuttal in that driver’s safety performance history. A driver may submit a rebuttal initially without a request for correction, or after a request for correction. Again, the rules do not specify a particular form for the rebuttal.

Within five business days of receiving a rebuttal from a driver, the previous employer must:

  • Forward a copy to the prospective employer; and
  • Add the rebuttal to the driver’s file and send it to sequent prospective employers for the duration of the three-year data retention requirement.
